1. Acceptance of Terms

By downloading, installing, or using PillowSync (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PillowSync is a mobile application that allows users to track and analyze intimate activities with their partners. The App provides features including session logging, partner pairing, statistics, and analytics.

3. Eligibility

• You must be at least 18 years old to use the App.
• You must have the legal capacity to enter into these Terms.
• You are responsible for ensuring that your use of the App complies with all applicable laws in your jurisdiction.

4. Account Registration and Security

• You may create an account using Apple Sign In.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.

5. User Content and Data

5.1 Your Content

You retain ownership of all data and content you create or upload to the App ("User Content"). By using the App, you grant us a license to store, process, and display your User Content as necessary to provide the App's services.

5.2 Partner Sharing

When you pair with a partner, you may choose to share certain User Content with your partner. You are solely responsible for what information you choose to share. We are not responsible for how your partner uses or discloses information you share with them.

Partner Data Handling: When you share data with a partner, that data becomes accessible to your partner according to your privacy settings. If you delete your account, data that you shared with your partner may remain visible to them until they delete their account or the shared data. If your partner deletes their account, data they shared with you will be removed from your view, but your own data remains unaffected.

5.3 Prohibited Content

You agree not to use the App to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others.
• Transmit any harmful, offensive, or illegal content.
• Impersonate any person or entity.
• Interfere with or disrupt the App's functionality.

6. Premium Features and Subscriptions

6.1 Subscription Terms

The App offers both free and premium features:

• Free Features: Basic session logging (score, protection used, toys used, lingerie used, private notes), basic statistics, and the ability to be paired by a premium user.
• Premium Features: Advanced session logging (orgasm tracking, positions, acts, ejaculation details, shared notes), detailed analytics, trend analysis, partner comparison tools, custom date range filtering, advanced chart visualizations, and the ability to initiate pairing with partners.
• Premium features require a paid subscription.
• Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.
• Subscription fees are charged to your Apple ID account.
• Free users who are paired with a premium user may access premium features for logs shared with that premium partner.

6.2 Subscription Renewal and Cancellation

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can cancel your subscription at any time through your Apple ID account settings.
• Cancellation will take effect at the end of the current billing period.
• No refunds will be provided for the current billing period upon cancellation.

6.3 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals.

7. Intellectual Property

• The App and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

• No Medical Advice: The App is not intended to provide medical, health, or relationship advice. The App is for informational and tracking purposes only.
• As-Is Service: The App is provided "as is" and "as available" without warranties of any kind.
• No Guarantees: We do not guarantee that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use of the App.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

12. Termination

• We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
• You may terminate your account at any time by deleting your account through the App's settings.
• Upon termination, your right to use the App will immediately cease, and we may delete your account and data.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
